Is disciplinary hearing necessary before termination?
The law explains an exceptional circumstance, where an employer may not conduct a disciplinary hearing, instead dispense the employee, when the employee has agreed in writing to have commit the offence subjected to. And this action requires the consent of the employee too.
When is disciplinary hearing necessary?
An employer is obliged to take disciplinary action either through penalty or discrimination. For an employee charged with criminal offenses, disciplinary action may not be taken on the same offense until the final determination of the criminal case.
